TERMS & CONDITIONS

SBCS proposes to furnish Equipment, Permit, Labor, Materials & Disposal for the scope of work provided.

1. Stonebridge Construction Services, LLC will be signified as SBCS throughout this document. Building is used to signify home or any building.

2. Start Date: Unpredictable weather & prior jobs taking longer than expected, may delay your start date. Please know that your date may change and if it does, we will notify you as soon as possible.

3. Permit Package & HOA: By signing below you authorize SBCS to act as an authorized agent when recording your Notice of Commencement.The permit package, which contains the permit and all the required documentation for the materials being use with the Florida approval numbers, will be taped to the front of the building. This package must remain in place until the final inspection. If the package is removed by the building owner or it’s tenants before the final inspection, the county/city will charge a re-inspection fee. This will be the building owner responsibility and added to the final bill. If your neighborhood is governed by an HOA (Homeowner’s Association) you must check with the association board and obtain an approval letter for the type & color of material, you have chosen.

4. Facilities: The owner shall permit the use of all necessary utilities at the job site, such as water & electricity. The use shall be free of charge to SBCS, unless prior arrangements are made in writing. The dumpster and materials need to complete the roofing project could arrive 1-2 days prior to the work beginning. In the instance where the building owner’s yard, driveway, parking lot or any property is damaged during the delivery of the material or dumpster, SBCS insurance does not cover the damages and cannot be held responsible. Additionally, any vehicle occupying the drop off location must be moved prior to the dumpster arrival and pickup. Any cars in the garage that will need to be used during the roof process, must be moved as well or they will be blocked in.

5. Pictures on walls & attic storage: Please remove all pictures and breakable items from the walls. SBCS cannot be liable for items that fall from walls or ceiling during the installation. Additionally, activity on the roof could cause small pieces or wood, granules, dust, and nails to fall into your attic or other areas below your roof deck. If you are using the attic for storage, consider covering these items with plastic or remove prior to work. Lastly, be cautious when opening your attic access. Nails & debris may be resting on top of this access when you open it.

6. Multiple Layers: SBCS estimating team will always do their best inspection during the initial estimate visit but, some roofs may have additional layers of shingles or underlayment that can’t be seen until the roof removal process begins. If your roof has more than one layer, there will be an additional charge of $.45 per square foot, per layer. In addition, if the existing roof had peel & stick or multiple layers of underlayment, an additional charge of $.20 per square foot may apply.

7. Satellite/Antenna Removal: If there is a satellite or antenna on the roof that must be removed to complete the roofing project, it will be the building owner’s responsibility to have it re-installed by their provider. All cost associated with the re-installation and calibration will not be SBCS’s responsibility.

8. Various Reinstallations/Gutters/Drywall/Falling Fixtures/Sprinkler Heads/Landscape: As part of your roof repair or new roof installation, it is sometimes necessary to remove siding, gutters, gutter guards, fascia, soffit, metal flashing and other semi-custom installations done by a specialized contractor. Also, old siding or trim may be brittle to the touch. SBCS will exercise professional caution when removing these products and existing surrounding roof; however, damage is very possible to these products. Materials may be weather-beaten and/or brittle upon touching them due to age and condition of the material, along with previous installation method. SBCS is not responsible for the esthetic appearance of these products and may need to be reinstalled by a specialty contractor or replaced by a new product. Drywall cracks, nail pops, texture falling, or any falling fixture attached to the ceiling or walls may occur. SBCS is not responsible for this & the owner is responsible for hiring their own painter or tradesman to correct this. SBCS is not responsible for any painting of existing or new materials installed. This will be the owner’s responsibility after the project has been completed. Owner is responsible for marking sprinkler heads with flags, SBCS will not be responsible for broken sprinklers if not marked. SBCS cannot be responsible for damage to the yard/grass, trees, plants, flowers, surrounding landscape, as well as outdoor furniture. There will be some impact to these areas, it is unavoidable. Please make sure to protect or move any items that is close to the perimeter of the home for falling debris.

9. Roof Deck Penetration: During the new roof installation, shingle nails, dry-in nails, & decking nails will penetrate through the roof deck. Please remove any stored items that are stacked up against the decking to prevent damage to your personal belongings. Also, if your house has been re-piped or re-wired in the past, please inform SBCS so we can inspect for pipes & electrical wire that may be touching the bottom of the roof decking. All mechanical items will need to be moved to proper location prior to the project starting. SBCS will not be held responsible for any water damage caused by pipes, electrical shortages/damages or A/C vents/lines that have been punctured by roofing nails during the removal or installation of roofing system install process.

10. Wood Cost & Wall Flashing: It is Florida Building Code to replace any rotted wood or wall flashing we find in the roof assembly during the roof replacement process. Most of the time this cannot be seen until the roof shingles & underlayment have been removed. This wood or flashing will be replaced at an additional cost & added to your final invoice. The cost is $8/ft fascia board or framing, $3.50/ft for 1×2 fascia nosing, $65/sheet 7/16” OSB plywood, $85/sheet for 15/32” CDX plywood, $100 for 5/8” plywood, $4.50/ft for 1×6 roof decking, $9/ft for wall flashing.

11. Right to Repair: SBCS is to be immediately notified in writing within (3) days of first knowledge of defect by owner or their agent. SBCS shall be given first opportunity to evaluate and make repairs, replacements, or corrections to the defective construction within a reasonable period. SBCS reserves the right to refund the purchase price of the product in lieu of repairing or replacing the product.

12. Safety: Roofing projects can be very dangerous, please keep all adults, children, and pets away from the work area. There will be debris falling from the edge of the roof and roofing debris around the perimeter of the structure, along with nails. We do not want anyone to get hurt. For this reason, no one besides roofing crew and/or SBCS representative are allowed on the roof while the project is in progress. SBCS cannot be held liable for any injuries while the project is being completed.

13. Skylights & Sun Tunnels: SBCS recommends replacing skylights and sun tunnels at the same time as the roof. If the customer decides against replacement, SBCS will not warranty any leaks around these items unless agreed in writing. Also, if the interior drywall or trim needs to be replaced or re-finished, it will be the homeowner’s responsibility to have these item corrected.

14. Extra Material: It is industry standards to order extra material for the project. This extra material will be picked up by a SBCS representative and does not belong to the homeowner. The material will be returned to the vendor. Please do not place the extra material in an area that is not accessible for our representative.

15. Cast Iron Pipe: Stonebridge is not liable for damage done during roof deconstruct on cast iron pipes.

16. Legal: If either party is involved in legal proceedings (litigation or arbitration) to enforce any provision of this proposal or to protect its interest in any manner arising from this proposal, the party prevailing in such proceeding shall be entitled to recover reasonable costs, court fees and attorney fees, incurred in such proceedings.

17. Tenants: It is the owner’s responsibility to inform any tenants or persons at the property of the stipulations in this contract to avoid injury, delays, or confusion.

18. Warranty: SBCS provides a Fifteen-Year workmanship warranty for shingle roof replacements and a Five-Year for flat roofs, unless otherwise written. Should the roof leak during the warranty period, due to the failure of workmanship, repairs will be made (including material for the specified area) at no charge to the original owners. SBCS must be the first company contacted to repair your roof while under warranty. If any company does repairs to a SBCS roof, the warranty will be voided. If a warranty repair is required, the customer must contact SBCS and allow reasonably sufficient time to respond based on the condition described. If there are any damages to the property, SBCS must have the right to use our own contractor. Warranty is only valid on work that has not been subject to accident, acts of God, misuse, or abuse. Work that has not been subject to mold, mildew, fungi, bacteria, or any organism, as well as any tree debris, leaves, or pollen. Work that has not been modified, altered, defaced, or had repairs or attempts by others.

19. Payment Terms: Unless otherwise stated in this agreement, payment terms for this contract shall be in accordance with Florida Statutes 713.346 and 715.12. Once Stonebridge has completed the work in accordance with the contract terms outlined herein, a request for payment shall be submitted. Once received by the owner, payment shall be received by Stonebridge no later than 14 days from receipt of the payment request. Projects involving insurance funds are also governed by this section as it is the responsibility of the owner to provide payment regardless of the insurance company’s payment schedule. All Credit Cards Payments will incur a 3% service charge for Visa, Master Card and Discover. America Express will incur a 4%.

20. Florida Homeowner’s Construction Recovery Fund: Payment, up to a limited amount, may be available from the Florida Homeowners’ Construction Recovery Fund if you lose money on a project performed under contract, where the loss results from specified violations of Florida law by a licensed contractor. 21. Florida Lien Law (This must be in contract to be binding in Florida)
ACCORDING TO FLORIDA’S CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.37, FLORIDA STATUTES), THOSE WHO WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A RIGHT TO ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION LIEN. IF YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB-SUBCONTRACTORS OR MATERIAL SUPPLIERS, THOSE PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF YOU HAVE ALREADY PAID YOUR CONTRACTOR IN FULL. IF YOU FAIL TO PAY YOUR CONTRACTOR, YOUR CONTRACTOR MAY ALSO HAVE A LIEN ON YOUR PROPERTY. THIS MEANS IF A LIEN IS FILED YOUR PROPERTY COULD BE SOLD AGAINST YOUR WILL TO PAY FOR LABOR, MATERIALS OR OTHER SERVICES THAT YOUR CONTRACTOR OR A SUBCONTRACTOR MAY HAVE FAILED TO PAY. TO PROTECT YOURSELF, YOU SHOULD STIPULATE IN THIS CONTRACT THAT BEFORE ANY PAYMENT IS MADE, YOUR CONTRACTOR IS REQUIRED TO PROVIDE YOU WITH A WRITTEN RELEASE OF LIEN FROM ANY PERSON OR COMPANY THAT HAS PROVIDED TO YOU A “NOTICE TO OWNER.” FLORIDA’S CONSTRUCTION LIEN LAW IS COMPLEX, AND IT IS RECOMMENDED THAT YOU CONSULT AN ATTORNEY.

22. RIGHT TO CANCEL: You may cancel this contract without any penalty or obligation within 3 business days of the signed contract and receive a full refund of all payments made to SBCS. This must be submitted in writing.
